Terms and Conditions

1. Acceptance of promotion terms and conditions:

1.1 This promotion is run by Mt Eden Village Incorporated (‘MEVI’, ‘the Promoter’) (‘the Promotion’). By entering the Promotion, you agree to these terms and conditions. If you do not agree to these terms and conditions, you may not enter and you are not eligible to redeem the prize.

2. What is the Prize(s)?

2.1 There will be one or multiple Prize winner(s) (‘Winner(s)’), with the Prize(s) being specified in the Promotion and associated Promotion marketing material (‘the Prize(s)’).

2.2 In the event that the Prize(s) (or any item of the Prize(s)) specified in the Promotion and associated Promotion marketing material becomes unavailable for any reason, MEVI, and/or any supplier of a part of the Prize(s), reserves the right to replace or substitute an item of similar or equal value.

3. Who can enter?

3.1 All Promotion entrants must:

  • Enter their correct contact details;

  • Be eighteen years of age or over (MEVI reserves the right to ask for age and identity verification information prior to the Winner(s)redeeming a Prize(s));

  • Be a New Zealand resident;

  • Be an individual person (i.e., not a business, club or school); and

  • Complete the entry instructions presented on the Promotion page, and in accordance with these terms and conditions, within the Promotion specified period.

4. How to enter

4.1 To enter to win, an entrant must:

  • Fill in the entry form as specified in the Promotion with your accurate details;

  • Only create one entry (there is a limit of one entry per person). Unless the Promotion is a shopping and dining competition, in which case, an entrant may enter as many times as the entrant wishes and is eligible for (based on the number of separate transactions).

5. Prize(s) redemption

5.1 Where the Winner(s) is required to claim the Prize(s) in person, they must provide appropriate identification (e.g. driver’s licence, passport, birth certificate).

5.2 Delivery arrangements for the Prize(s) will be discussed and agreed directly with the Winner(s). Timing of the delivery of the Prize(s) (or parts of the Prize(s)) may differ depending on the specific supplier of each component of the Prize(s). Due to the size and nature of the Prize(s) items, complete delivery of some components of the Prize(s) may take some months to complete.

5.3 Except for the items stated in the Promotion or Prize(s), any additional expenses, including delivery costs where relevant, associated with claiming the Prize(s) are the Winner’s sole responsibility.

5.4 MEVI reserves the right to refuse to reward the Prize(s) to an entrant who MEVI decides (in its sole discretion) has violated the terms and conditions, gained unfair advantage in participating in the Promotion or won using fraudulent means.

5.5 The Prize(s) is not transferable, exchangeable or redeemable for cash. No other family members, friends, office associates or any other person will be able to redeem the Prize(s) on the Winner’s behalf.

6. Winner(s)notification and announcement

6.1 As soon as reasonably possible after the Promotion end date, MEVI will draw at random the Prize winner(s). The winner(s) will be contacted via the phone number provided by the entrant as part of the Promotion entry form. If a Winner(s) cannot be contacted within three working days of the initial contact made by MEVI, MEVI reserves the right to redraw the Prize(s). The final decision in respect of any Prize Winner(s) is at the sole discretion of MEVI and no correspondence will be entered into.

6.2 By participating in the Promotion, entrants grant MEVI permission to use their names, characters, photographs and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.

6.3 All times stated in the Promotion, including the Promotion end time, refer to New Zealand local time and all references to currency refer to New Zealand Dollars.

7. Exclusion of Liability

7.1 To the fullest extent permitted by law, MEVI, its executive committee members  and any associated promoter(s), associated agencies and/or companies shall not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever suffered (including, without limitation, indirect or consequential loss) or for any loss or damage or personal injury suffered or sustained in connection with the Promotion. MEVI’s liability to any entrant or Winner(s)will be limited in any circumstances to a maximum for all claims up to the value of the Prize(s).

7.2 The Winner(s) takes the Prize(s) entirely at their own risk and indemnifies MEVI in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the Prize(s). The Winner(s) is responsible for all insurance, tax or other costs that may be associated with the Prize(s). Where the Prize(s) has associated terms and conditions the Winner(s) accepts the Prize(s) subject to those terms and conditions and restrictions. Any vouchers and products as part of the Prize(s) are subject to the specific organisation and product warranties and terms and conditions.

7.3 Neither MEVI nor the promoter is liable for any tax implications that may arise as a result of winning the Promotion or a Prize(s).

8. Privacy

8.1 Any personal information provided by an entrant will be held by MEVI in accordance with its obligations under the Privacy Act 2020 and the MEVI Privacy Policy. The personal information collected will be used by MEVI to contact potential, and eventual, winners of the Promotion. In addition, by entering the Promotion, all entrants agree to receive marketing and promotional material from MEVI.

8.2 Individuals can be removed from receiving these communications by following the applicable ‘unsubscribe’ link on any MEVI email or by contacting MEVI directly.

8.3 MEVI will not sell, disclose or distribute the personal information provided by customers to any person, organisation, agency or other third party (except as required by law) and as provided for in these terms and conditions.

8.4 This Promotion is in no way sponsored, endorsed by or administered by Facebook, Instagram or Google.
